1. Agreement to Terms

By accessing or using the E-Fax Easy service operated by AIT Corporation ("Company," "we," "us," or "our") at efaxeasy.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the service.

2. Description of Service

E-Fax Easy is a cloud-based fax transmission service that enables you to send and receive faxes over the internet without the need for physical fax hardware. The service converts digital documents (PDF, TIFF, DOC, DOCX) and transmits them via T.38 fax protocol through our carrier partner, VoIP.ms. Incoming faxes are received, converted to PDF, and made available in your online dashboard.

3. Acceptable Use

You agree not to use E-Fax Easy to:

• Transmit unsolicited bulk faxes (spam) or junk fax advertisements.
• Send any content that is unlawful, threatening, abusive, defamatory, obscene, or otherwise objectionable.
• Violate the Telephone Consumer Protection Act (TCPA) or any applicable federal, state, or local law governing fax transmissions.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Attempt to gain unauthorized access to the service, other user accounts, or connected systems.
• Transmit viruses, malware, or other harmful code through documents uploaded to the service.

We reserve the right to suspend or terminate your account if we determine, in our sole discretion, that you have violated this acceptable use policy.

4. Accounts and Billing

Paid plans are billed monthly via Stripe. Your subscription begins at the end of your 30-day free trial unless you cancel beforehand. If you cancel, your account will be downgraded to the Pay-as-You-Go tier (send-only, 10 free pages/month, $0.15/page thereafter). All plans require a credit card on file. You are responsible for maintaining accurate billing information and for all charges incurred under your account. Pages sent beyond your plan's included allotment are billed as overage at the per-page rate specified for your plan. Optional add-ons (such as inbound fax lines) are billed separately at the listed rate.

Pricing is subject to change at any time. We will notify you of any pricing changes at least 30 days in advance via the email address associated with your account. Updated pricing will take effect on your next billing cycle following the notice period. If you do not agree to the new pricing, you may cancel your subscription before the changes take effect.

5. Data Retention

Fax documents (sent and received) are retained for 90 days from the date of transmission. After this period, documents are permanently deleted from our servers. Pay-as-You-Go accounts retain documents for 30 days. You are responsible for downloading and archiving any documents you wish to keep beyond the retention period.

6. HIPAA Disclaimer

While E-Fax Easy is designed with security measures appropriate for handling sensitive documents, including encrypted transmission via T.38 protocol, we do not guarantee full HIPAA compliance for all plan tiers. A Business Associate Agreement (BAA) is available for Enterprise Plus, Enterprise Pro, and Enterprise Ultimate plan subscribers upon request. It is your responsibility to ensure that your use of the service complies with HIPAA and any other applicable regulations governing protected health information (PHI).

7. Third-Party Services

E-Fax Easy relies on third-party service providers to deliver the service, including VoIP.ms as the telecommunications carrier for fax transmission. We are not responsible for any failures, outages, or service disruptions caused by third-party providers. Fax delivery is subject to the capabilities of the receiving fax machine and telephone network conditions.

8. Limitation of Liability

To the maximum extent permitted by applicable law, AIT Corporation and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of or inability to use the service.

Our total aggregate liability for any claims arising from or related to the service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim. The service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory.

9. Intellectual Property

The E-Fax Easy service, including its software, design, logos, and documentation, is the property of AIT Corporation and is protected by copyright, trademark, and other intellectual property laws. You retain ownership of all documents you transmit through the service.

10. Termination

We may suspend or terminate your access to the service at any time, with or without cause and with or without notice. Upon termination, your right to use the service ceases immediately. You may cancel your account at any time from your billing settings.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of laws principles.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated terms on this page and updating the "Last updated" date. Your continued use of the service after changes are posted constitutes your acceptance of the revised terms.
